Privacy Notice (KVKK)

1. Who is the data controller?

The purpose of this Privacy Notice for Website Visitors (the “Notice”) is to fulfill our obligation to inform website visitors under Article 10 of the Turkish Personal Data Protection Law No. 6698 (the “Law”) and the related Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform.

The data controller is TECT BİLİŞİM TEKNOLOJİLERİ ANONİM ŞİRKETİ (“TecT”), registered with the Kocaeli Trade Registry under number 38867 and with MERSIS number 0833115999400001, address: GOSB Teknopark, Kemal Nehrozoğlu Cd. 400. Sk. No:507 D:9-207, 41400 Gebze, Kocaeli, Türkiye.

2. Which personal data do we process?

Through this website we process the following categories of personal data: identity data (name, surname), contact data (e-mail), customer transaction data (requests and complaints; your message; the topic of your request, the product and country you are interested in, and your SAP release; the page you submit the form from and the site language), professional data (the company you work for).

If you give consent in the cookie banner, we also process, through the LinkedIn Insight Tag, transaction security data (IP address, cookie identifiers) and marketing data (pages you visit, the referring page, browser and device information, time of visit). If you do not consent, this data is not collected.

When contacting us through the forms on our website or by e-mail, please do not share personal data beyond what we request, and never share special categories of personal data (such as race or ethnic origin, political opinion, religious or philosophical belief, physical or mental health, genetic or biometric data, association or union membership, dress, sexual life or orientation, criminal convictions and security measures).

3. For which purposes do we process your personal data?

We process your personal data for the purposes listed below, by data category.

a. Identity, contact, customer transaction and professional data: (i) to follow up and respond to the requests and complaints you send through the forms on our website or by e-mail, under Article 5(2)(c) of the Law (processing the personal data of the parties to a contract is necessary, provided that it is directly related to the establishment or performance of that contract) and, where you contact us on behalf of the organisation you work for, Article 5(2)(f) (processing is necessary for our legitimate interests, provided that it does not harm your fundamental rights and freedoms); and (ii) to plan our products and services by evaluating requests by topic, product and country as aggregated figures that do not identify you, under Article 5(2)(f) of the Law.
b. Transaction security and marketing data collected through the LinkedIn Insight Tag: only if you consent in the cookie banner, to produce aggregated and anonymous statistics on the LinkedIn members who visit our website, such as their industry, job title and company size, and to measure the results of our LinkedIn ads, on the legal basis of your explicit consent under Article 5(1) of the Law.

4. Form data: collection method, storage and transfer

Form data is collected electronically when you fill in and submit a form on our website. It is stored on the servers of Amazon Web Services in Frankfurt (Germany), where our website is hosted, and is forwarded through the Amazon Web Services e-mail service (Amazon SES) to our corporate mailbox on Microsoft 365 (info@tecteknoloji.com) so that your request reaches our team, and it is also stored there. E-mails you send directly to this address are likewise stored on Microsoft 365.

In this context your data is transferred, for the purposes set out in section 3(a), to our service providers Amazon Web Services and Microsoft, and is processed on their servers outside Türkiye. Under their contracts with us, they process it as data processors to provide these services, and may also process it for limited purposes set out in those contracts, such as security, abuse prevention and legal compliance.

The form records in our website database are kept for 2 years after your request is closed; at the end of that period they are deleted, leaving only aggregate figures (month, country, topic and product) that do not identify you.

5. LinkedIn Insight Tag: collection method, transfer and withdrawal of consent

Data processed through the LinkedIn Insight Tag is collected electronically and by automated means, only if you consent, through cookies placed in your browser, your browser’s local storage and the LinkedIn Insight Tag. It is sent directly from your browser to LinkedIn’s servers. The list of cookies and their lifetimes is in the Cookie Policy.

This data is transferred to LinkedIn, established outside Türkiye, for the purposes set out in section 3(b). The service is provided by LinkedIn Ireland Unlimited Company for the European Union, the European Economic Area and Switzerland, and by LinkedIn Corporation elsewhere. LinkedIn processes this data on servers outside Türkiye, including in the European Union and the United States. LinkedIn may also process this data as a separate controller for its own purposes, such as providing, measuring and improving its advertising services, as described in its Privacy Policy; you can also exercise your rights regarding that processing directly against LinkedIn. TecT receives from LinkedIn only aggregated reports that do not identify you.

You can withdraw your consent at any time by choosing “Decline” in the banner that opens from the “Cookie preferences” link at the very bottom of the page. Once you withdraw it, the page reloads and the LinkedIn Insight Tag is no longer loaded; LinkedIn cookies on our domain and LinkedIn entries in your browser’s local storage are deleted. You can delete cookies on LinkedIn’s own domain (linkedin.com) in your browser settings. Withdrawal does not affect the lawfulness of processing carried out before it.

6. What rights do you have?

Under the Law you have the right to: learn whether your personal data is processed; request information on how it has been processed; learn the purpose of processing and whether the data is used in line with that purpose; know the third parties in Türkiye or abroad to whom your data has been transferred; request correction of incomplete or inaccurate data; request erasure or destruction of your data within the conditions set out in the legislation; request that corrections, erasures and destructions be notified to the third parties with whom your data was shared; object to a result against you arising from analysis of your data solely by automated systems; and claim compensation if you suffer damage due to unlawful processing.
